MSNBC analyst John Heilemann falsely claimed during Monday’s “Morning Joe” that the Trump administration is hoping the Supreme Court will grant it the authority to capture and deport U.S. citizens.
The outlet focused on the saga of Salvadoran illegal immigrant Kilmar Armando Abrego Garcia, an MS-13 member who has had a deportation order since 2019 and was finally sent back to El Salvador last month.
According to the media, Abrego Garcia was illegally living in the U.S. after entering the nation from El Salvador and “was wrongly deported” back to his home country last month.
However, Secretary of State Marco Rubio explained during a Monday Oval Office meeting with El Salvador President Nayib Bukele and President Trump, “This individual was a citizen of El Salvador. He was illegally in the United States and he was returned to his country. That’s where you deport people, back to their country of origin.”
Top Trump advisor Stephen Miller also pointed out Abrego Garcia was not “mistakenly” deported and that he was ordered to be deported back in 2019 but a disgruntled Democrat DOJ lawyer sabotaged the situation by incorrectly filing the deportation as a “mistaken removal.”
Regarding reports that Abrego Garcia had a “withholding order,” which means an immigration judge blocked him from being sent to a particular country, Miller explained the order is null and void because the illegal alien is part of MS-13, which is designated as a foreign terrorist organization.
“Since he’s in MS-13, there is no withholding order. Furthermore, that gang he is accused of being persecuted by doesn’t exist anymore in El Salvador! The 18th Street gang is GONE,” Miller stated.
MSNBC anchor Jonathan Lemire was asked to gauge the level of public outrage from the Trump administration’s deportation efforts and he said, “The White House deliberately chose who they thought were, quote, unsavory characters that there wouldn’t be mass unrest, mass uprising to protest and try to defend them.”
Of course, even during his 2024 presidential campaign Trump promised to go after illegal aliens who are violent criminals or gang members before eventually deporting those who are in the U.S. illegally but haven’t committed a second crime while in the country.
Lemire continued to claim the Trump White House is using the Supreme Court to protect itself from being criticized for the deportations since the court ruled 9-0 in favor of using the Alien Enemies Act to exile the “undocumented” invaders.
The MSNBC host said, “We should note, President Trump, we heard them on Friday saying, well, we’ll agree with, we’ll defer to the Supreme Court. Well, everything administration has done since then, saying, ‘No.’ Basically saying, ‘Well, that’s not our problem anymore.'”
That is when Heilemann chimed in, “This is not just about immigrants who are in this country illegally, this is not just about this case. This is not just about this El Salvador, the specifics of this case. As Justice Sotomayor noted last week, the Trump administration’s claim, legally, is that they can take anyone in the United States and disappear them to a foreign country, and that even if they acknowledge that that was an error of any kind, that they are powerless to bring that person back to the country.”
“That’s not just about Mr. Garcia,” he added. “It’s not just about illegal illegal immigrants. It’s not about criminal illegal immigrants, it’s about everybody in the United States. Anybody is what their legal claim is. Justice Sotomayor as I said made this very clear last week. That’s the principle and the legal precedent that’s at stake here, and it is setting up, if there’s anything we may or may not be in a constitutional crisis already. But if the administration continues to hew to that line, we will be in an unequivocal constitutional crisis, and I think that day is very, very close at hand.”
